I was sitting there as an observer, just watching him, that monster. Disgust filled my mind as I attempted to clear my head. How did I let this happen? I watched as my Gandalf the grey action figure lay down lifelessly while my clone trooper R.C. car continuously ran over him. My complete and utter anger filled the room. I knew deep in my heart that justice needed to be served. I pulled up my tech deck halfpipe and placed the Star Wars: Attack of the Clones car on one side and my poor Gandalf toy that claimed he was involved in a hit and run accident committed by the clone trooper. The clone trooper claimed he was just executing order 66. At the time I was 8. I had some concept of what democracy was, I knew what a trial was mainly because my mom and my cat’s favorite show was Judge Judy. In the end, I was unsuitable to judge the clone because of my anger. I soon invited Peanut the cat to decide his fate. My revelation hit me that I was unfit to judge even at my young and ignorant self. I had a steady but limited concept of what is known as bias. As I grew older my perception of the world around me began to change, to my understanding bias grew more prevalent and distinct. Specific current events began to change the way I think about it, especially so in the recent Kavanaugh Trials.
The Investigation
Brett Kavanaugh former District of Columbia Lawyer has been accused of sexual misconduct 36 years ago by Dr. Christine Blasey Ford, a project director that works with the FDA to develop accurate models for precise information for medical and scientific studies. Before we discuss the investigation we have to go back to the allegations themselves. On a 1982 summer night in D.C., Dr. Ford noted she was attacked by a group of boys potentially trying to sexually assault her and she claims Brett Kavanaugh was “100 percent” certain he was the perpetrator. She claims he groped and touched her inappropriately. Brett Kavanaugh claims that the allegations also made by Julie Swetnick are “ridiculous and From the twilight zone”. Now, the evidence has been presented to the Senate, the partisan parties have now discussed Dr. Fords claims from the Senate investigators, but you are probably not asking the question what do the Senate investigators do. But I will still explain, In short, they conduct interviews, background checks and polygraph tests, simple investigation practices, this is important. After the investigation, the senators have finished deciding their stance on the decision to approve or disapprove Kavanaugh to the supreme court, or they are Lisa Murkowski (AK) and Susan Collins (ME). The two swing votes that make or break the case. Now the testimony of Dr. Ford and Brett Kavanaugh have both proved to have pieces of evidence and contradictions weaved into their striking realities. Due to confusion and the certitude of the allegations still left up into question, President Donald J. Trump orders an F.B.I. investigation… and both parties rejoice.
What does an F.B.I. investigation Do?
In Short, they conduct interviews, background checks, and polygraph tests, simple investigation practices, and if you haven’t noticed I copied the exact quote I stated earlier with what the Senate investigators do. But the argument is brought up about the resources the F.B.I. has on their equipment belt. Furthermore, I stated that a Federal agency has the same amount of jurisdiction and resources as a branch of the Federal government. In fact, they do! The specifics of the investigation revolves around voluntary interviews without a subpoena or a definite victim or suspect. To further my confusion I will relay the process, Question Dr. Ford and Brett Kavanaugh, Followed through both by the F.B.I. and the Senate. Comb through alibis and mentioned statements of that summer. Both finished by the Senate and the F.B.I. And finally the polygraphs, a minor portion of the investigation. Only Dr. Ford was questioned with a polygraph for both the Senate and F.B.I.
Now you may be wondering why was their excitement from both parties. Good question, I have no idea, actually that’s false I have somewhat of an idea. That is how conservatives would rather have Brett Kavanaugh proven innocent by the investigation while Democrats would have him be proven guilty. But, That’s not what the FBI does. They are not judge, jury, and executioner they simply convey information and report back to the Senate investigators, which then put forth information from the investigation to the Senate.
The Problem is… Bias.
The Issue
It has come full circle that in the end, bias is the issue. Now what I mean by that is how both parties will almost always vote for what their party represents and not how they actually feel about the investigation. This is bad. If a group of 100 people is voting and it only comes down to two people. Think about it like this, we thought about this trial as a movement or victory for either. But bias nudged itself into the equation that turned a trial into a political power move that would’ve declared an advantage over the other party. According to PBS, Mitch Mcconnell, the known leader of the Republican Senate, states “plow right through it”, by that he means let’s get this trial going people we need to do our job and confirm Kavanaugh. Chuck Schumer. The leader of the democratic senate is also guilty of this but in more of his own way of his own fixed mindset of “I will oppose Kavanaugh with everything I’ve got”. This was never about the sexual misconduct of Brett Kavanaugh, this was about how can we have the next advantage in the supreme court for the next 40 years.
The Solution
The simple solution to a simple problem, Ha!, Not! There can actually be many solutions to this issue like just vote for someone you trust or write to your congressmen. I disagree, Let me pick your brain for a little. Remember how the F.B.I investigation barely meant anything back when Kavanaugh was getting elected? What if, now hear me out I know this may seem horribly radical but in my wholesome heart,
I believe the F.B.I, should have total and complete control over the Senate proceedings of Kavanaugh.
Okay, okay lets real it back in just a little bit before I let your mind wander. The senates votes for the Kavanaugh case were completely partisan in the first place. The F.B.I on the hand is totally neutral they just relayed information based on evidence. Now, I realize this completely violates everything that stands for in America like due process and our constitution in general. But if you think about it, a group of totally neutral people who wouldn’t be concerned whether their political party was elected or not, would be pretty nice. Lets put together a hypothetical scenario of how this would go down, The F.B.I would collect their evidence. Then, they would process a group of people who would vote on it. Then they would hold a trial with Kavanaugh and they would decide if he is fit to be a supreme court justice. Doesn’t sound too crazy or absurd, I mean it’s about as absurd as your drunk uncle at Christmas. But I mean come on, is it more absurd or as ridiculous as trying him to 100 people who already know who they are going to vote for before they hear the evidence?
Conclusion
I know that this topic seems very radical with a lot of concerns with it like “everyone is biased” and “It inspires corruption” and I would address those as correct. This is more than an average Senate case, actually, it’s probably the biggest in a while, but it’s more than a specific solution to a specific problem. I like to see it as a creative solution to a difficult problem. There are flaws to it and I can see them, but should the rest of America’s history be decided by 100 people with fixed opinions? Should the F.B.I have more control over a certain case? Should I think over my blog topic before I chose it? Let me know.
